As of January 1, 2004, the Personal Information Protection and Electronics
Document Act (PIPEDA) went into effect. Broadly speaking, the law applies
to organizations carrying on a commercial activity. As its title suggests,
the Act is aimed at ensuring the protection of personal information
and requires that businesses develop a privacy policy that meets the
new law's requirements.
Our Privacy Policy
As part of our service commitment to you, we wish to confirm the information
that we hold about you and how it is used. If you receive one or more
of our newsletters, we have collected your contact information, your
preferences regarding the notices you wish to receive and how you wish
to receive them. As a recipient or our newsletters, we will also notify
you of gallery exhibitions and other events that may be of interest
to you and information regarding any particular new pieces of artwork
the gallery has acquired. In addition, we may send you holiday cards
and other greetings. We only use your information for these related
purposes and do not disclose your information to third parties without
your knowledge and consent.
Feheley Fine Arts has appointed a Privacy Officer to oversee the implementation
of our privacy policy and to be available to address questions and concerns
related to the gallery's handling of personal information.
What is Personal Information?
Personal Information is any information that can be used to identify
a particular individual. This information can include any range of facts
about an individual such as: name, gender, age, preferences, or details
surrounding a dispute between a merchant and consumer. Personal information
does not include that which is available in the public domain, such
as information appearing on a business card, or addresses and telephone
numbers found in a telephone book.
Who We Are
Feheley Fine Arts deals in contemporary Canadian art and has been instrumental
in the development of numerous private and corporate collections. The
gallery organizes many exhibitions and events throughout the year and
offers services including art appraisal, collection management, display
and exhibition.
Our employees undertake various tasks including art appraisal, display
building, the writing of our newsletter, and the provision of administrative,
bookkeeping and technological services. Because of the nature of their
duties, our employees may have access to personal information of people
who deal with the gallery. Employees will comply with PIPEDA requirements
for handling persona information.
On occasion, we rely on third parties, such as credit card companies,
website managers, cleaners, computer consultants and other service providers
to help us carry out our duties. We restrict their access to any personal
information we hold as much as is reasonable possible. We also have
their assurance that they follow appropriate privacy principles.
What Kind of Personal Information Do We Collect?
We collect names addresses, telephone numbers, e-mail addresses, purchase
information and we make note of any preferences you express to us regarding
particular art pieces. We record the personal information in our databases.
We use the personal information you provide us with in order to follow
up customer service with direct personal contact, to send out newsletters
advising on upcoming events, and in order to gage the interests of our
clientele so that we can bring in artwork and hold exhibitions that
will suit their needs and interests.
How Do We Handle Personal Information?
We follow PIPEDA requirements with respect to dealing with personal
information. Below is a summary of the law's main principles and how
we comply with them.

Feheley Fine Arts has a Privacy Officer who is available to respond
to any concerns regarding the gallery's handling of personal information.
All of the gallery's employees and volunteers have received training
on how to safeguard the privacy of personal information.
Any third party contracts contain provisions explicitly requiring
their adherence to PIPEDA.

Purpose for Collecting Information
Feheley Fine Arts collects personal information for the purpose
of providing customers with follow up service, and to send mailings
advising clients on upcoming exhibitions, events and on the gallery's
latest acquisitions.
Related purposes for collecting personal information include invoicing
goods and services rendered. Anytime the gallery collects personal
information for any other purpose, we will identify why the information
is being collected.

Consent
The individual's knowledge and consent are required for the collection,
use , or disclosure of the personal information. The gallery will
provide a means for individuals to give their consent to the collection,
use and disclosure of any personal information, and to withdraw
their consent at any time.

Limiting Collection
The gallery will only collect information for the purposes it identifies.

Limiting the Use, Disclosure and Retention of Personal Information
Information will only be collected if there is a specified purpose
for collecting it.
Personal information will be retained only as long as necessary
for the fulfillment of the purposes outlined.
The gallery will only use or disclose personal information for the
purposes which it was collected, or, as required by law.

Accuracy of Information
Personal information will be correct and up to date. Individuals
will have the opportunity to access their personal information in
order to verify its accuracy and to request changes if necessary.

Security
Feheley Fine Arts uses appropriate security measures to protect
against loss, theft, unauthorized access, disclosure, use or modification
of personal information. Such measures will vary depending on the
sensitivity, amount, format, nature and storage of the personal
information and will involve, as applicable, physical, organizational
and electronic security measures, including premises security, restricted
file access to personal information, technological safeguards such
as passwords.
In communicating with us, you should be aware that e-mail is not
a fully secure medium.

The Privacy Policy is available on the Feheley Fine Arts website

and is also available in the form of hard copy at the gallery.
Individuals may contact the gallery's Privacy Officer at any time
to inquire about its management of personal information.

Individual Access
Individuals may access their own personal information upon request in order to verify its accuracy, completeness or to request that changes be made. Amendments will be made if appropriate. All requests to have personal information removed from the gallery's databases will be respected.
Requests for access will be answered be the Privacy Officer no later than 30 days after the request is received.
